FAQ

Hand-overs

The technical hand-overs of the premises take place following the fulfilment of the conditions listed below:

  • receiving a notification about the possibility of the hand-over,
  • making payment of 100% of the price specified in the contract and recording it in the Seller’s account,
  • making payment for improvements carried out by a tenant,
  • making payment for interest.
  • Notifications about the possibility of an apartment hand-over are sent by the CSO in accordance with the deadlines included in the preliminary / development contracts.

Notarial deeds

In order to sign Notarial Deed, the following should be completed:

  • payments up to 100% of the contract value, in line with the payment schedule to the preliminary sale agreement,
  • payments related to possible improvements carried out by a tenant,
  • payment of any and all financial obligations, including service charges and possible interest,
  • fees for perpetual usufruct of land for the period from the date of signing of the notarial deed until the end of the calendar year (in case the purchased premises are built on land which is in perpetual usufruct).

You will be notified about the date when we are ready to sign the notarial deed by registered mail and by e-mail, whereas you will be informed about the amount of the above-mentioned fees within 7 days from the moment we contact you with regard to the date of signing. The specific date for the signing of the notarial deed will be determined after all the due payments are made. The draft notarial deed together with the amount of fees related to the signing of the deed will be sent to you by the notary’s office to the e-mail address provided in the contract, 3 days prior to the agreed date of signing of the contract for the establishment of a separate ownership of the premises.

Fees for premises following the hand-over

In accordance with the signed preliminary / development contract and the hand-over protocol of the premises, from the date of the release of the subject of the contract, you assume all the charges related with the maintenance of the premises, storage room and garage space.

Fees are paid in the form of a lump sum payment, and according to the lump sum payment rules, it is a monetary commitment in a pre-determined amount without settlement of costs. After the building is constructed, a geodetic survey is carried out and sent to the office so that a file can be established for the premises for the final contract transferring ownership. Therefore, the lump sum payment is calculated based on the area determined after the measurement is carried out, and therefore it may slightly differ from the one provided in the contract.

The fee is calculated for:

  • sq metrage of the apartment
  • garage space (the fee is calculated for each parking space, which means that in the case of a family place, the fee is charged for 2 places)
  • sq metrage of the storage space (if owned) as it is part of a residential unit. Pursuant to the Act on ownership of premises dated 24 June 1994, Section 2.4 states that: “the premises may be composed of, as its component parts, premises, even if they are not directly adjoined to it or were located within the land property outside the building in which the given premises were separated, in particular: basement, attic, cell, garage, hereinafter referred to as “adjoining premises”.

You sign a contract for the supply of energy to the unit after the hand-over of the premises at the RWE or other electricity supplier point of sale, on the basis of a preliminary / development agreement and the hand-over protocol.

Perpetual usufruct

According to the provision in the preliminary / developer agreement, you have undertaken to return the perpetual usufruct fee from the moment of signing of the notarial deed until the end of the calendar year in which the notarial deed is signed.

The amount is calculated on the basis of the following formula:

the total fee paid by the Seller for the perpetual usufruct of the plot of land on which the investment was built x the share of the property purchased by you in the joint real property (the area of ​​the unit together with the storage unit to the total area of ​​the common property) x number of days from the day of signing of the notarial deed until the end of the year.

Procedure for the changing of the payment deadline

If it is necessary to change the date of payment of a given instalment, please send an email to the email address: bok@robyg.com.pl together with the reason for the change and the date by which the instalment should be postponed.
